The Good Old Boy Network- Fact or Fiction?

I really enjoy your website.  I have a general question, though, that maybe you can shed some light on for me.. from a legal aspect:

Is it possible for a "local businessman", whom was once very successful, and whom also at one time in the past "donated" to a "local politician" in my county, be continually 'shown favor' over certain criminal activity??????  The reason I ask is this:  I am trying to go through a divorce from such a person (its been 2 years now).. my ex, the "local businessman", has had, over the past 7 years:  3 DUI's, 2 driving revoked, countless battery charges, telephone harassment, theft by deception, deceptive practices, failure to pay ALL taxes, failure to file tax returns for over 5 years, bad check writing, willful deprivation (the list can continue)... but not once has faced any seriousness to his "crimes".  Honestly, most are "dropped" or "quashed"... based on "the local law enforcement failed to properly define certain law breaking activities, or acted on false arrest".  The judge then drops the case.  Even when I walked into a courtroom after filing "telephone harassment" - the tapes were played in explicit nature of my ex detailing that he was going to burn down our home, and kill me, and the arresting officer testifying "that is exactly what the defendant stated to me he was going to do to her upon his arrest, and he was obviously intoxicated"... the judge threw THAT case out based on "the form of harassment is not clearly defined in the police report"... I was stunned.

Not to mention failure to pay his court ordered support, and he has an alcohol abuse problem... yet each and every time I set foot in the courthouse, it seems "I and my children" are the ones that are punished by countless continuances and absurd orders from the judge.

Is it possible for him to be favored, per se, because of his past "donations"?  I remain befuddled, and when I ask these questions to various legal experts, I get hardly an answer at all.  I know that laws vary from state to state, but what can a person do to stop certain corruption in what has been categorized here as "the county 'good-ole-boy' network"? 

If you don't care to answer, that is fine.... I am hoping one day to shed light on a very emotional problem that many other people, in a situation similar to mine that includes divorce, are having, or will have in the future.  I thought the theory of "its all about the children and whats best for them" was the focus - it seems my courtroom's focus is on "how can we keep "local businessman" happy and shove it to the wife"........

I'm going to have to assume that you live in Illinois (based on your email's originating IP address) for the sake of this email.

The answer to your second question, “Is it possible for him to be favored, per se, because of his past "donations"?” is “Yes” also.

“What can a person do to stop certain corruption in what has been categorized here as "the county 'good-ole-boy' network?" is a different story altogether and would require a detailed and objective look at all of the facts by a neutral third party (a film maker or journalist perhaps).  Experience dictates that your characterization of events is most certainly not going to be how your estranged husband would describe them and probably not how the local criminal justice system would look at them either; emotion tends to cloud judgment and rational objectivity.

If this can indeed be construed as a matter of political favor then the first question would be what position does the "local politician" hold and who maintains oversight of that political office?  If it is an elected judge, then I would suggest involving the Illinois Judicial Inquiry Board http://www.state.il.us/jib/default.htm.  If it is some other state, county or city official then you may refer to the "Political Ethics Bill In the State of Illinois" http://www2.sls.lib.il.us/MVCC/searchtips/archives/000801.html

Remember- some people are extremely clever consumers of legal advocacy; the best attorneys can perform miracles in the courtroom and aside from closing legal loopholes, there is nothing the judicial system can do about it except stand by and watch as the guilty go free (O.J. comes to mind).

The second question an impartial investigator may ask is, "Does this "local politician" maintain any sway over the local criminal justice system?  (Highly unlikely but...) If he or she does, then you should be looking to involve State or Federal Law Enforcement resources.  If this person does not realistically have that much power, then you should turn the magnifying class inward because everyone else is probably already chalking you up as a conspiracy theorist.

I would be involving bloggers and the media at every turn, they love stuff like this, but one word of advice:  Be very careful how you present your story- it is easy for the public to characterize women, passionate about their cause, as trivial, hormonal, and spiteful.  Be less emotional in your approach and more factual and objective; you might find more people willing to listen and help.

Everyone is Entitled Except for our Fallen Soldiers and their Families???

This came to me via email this morning and I immediately connected with the message.  I have always wondered why everyone feels entitled to large sums of cash as a result of suffering a loss or experiencing tragedy in their lives.  Sure, I'd be upset if I lost my wife in 9/11, but I'd certainly not feel that anyone OWED me money as a result of her death under those particular set of circumstances.  The life insurance policy would certainly have to cough up some dough- but that's what we bought the policy for in the first place.

But why exactly would I be entitled for my loss... for an unavoidalbe tragedy?

Why is it that the families of 9/11 victims are entitled to more money than the families of our fallen military service members- the soldiers who fight for freedom and democracy?  These soldiers, sailors, and airmen died in service to our country but the best we can do is a few thousand dollars, most of which is taxable? 

Why is it that our legislators and lawmakers cannot find a way to support our troops and their families better financially?

This is bullshit. 

If after reading the following you do not feel passionately, one way or the other, please follow the rest of the lemmings as they plunge off of a cliff.

I think the vast differences in compensation between victims of the September 11 casualty and those who die serving our country in Uniform are profound. No one is really talking about it either, because you just don't criticize anything having to do with September 11. Well, I can't let the numbers pass by because it says something really disturbing about the entitlement mentality of this country. If you lost a family member in the September 11 attack, you're going to get an average of $1,185,000. The range is a minimum guarantee of $250,000, all the way up to $4.7 million.
If yo u are a surviving family member of an American soldier killed in action, the first check you get is a $6,000 direct death benefit, half of which is taxable.

Next, you get $1,750 for burial costs. If you are the surviving spouse, you get $833 a month until you remarry. And there's a payment of $211 per month for each child under 18. When the child hits 18, those payments come to a screeching halt.

Keep in mind that some of the people who are getting an average of $1.185 million up to $4.7 milli on are complaining that it's not enough Their deaths were tragic, but for most, they were simply in the wrong place at the wrong time. Soldiers put themselves in harms way FOR ALL OF US, and they and their families know the dangers.

We also learned over the weekend that some of the victims from the Oklahoma City bombing have started an organization asking for the same deal that the September 11 families are getting. In addition to that, some of the families of those bombed in the embassies are now asking for compensation a s well.

You see where this is going, don't you? Folks, this is part and parcel of over 50 years of entitlement politics in this country. It's just really sad. Every time a pay raise comes up for the military, they usually receive next to nothing of a raise. Now the green machine is in com bat in the Middle East while their families have to survive on food stamps and live in low-rent housing Make sense?

However, our own US Congress voted themselves a raise. Many of you don't know that they only have to be in Congress one time to receive a pension that is more than $15,000 per month. And most are now equal to being millionaires plus. They do not receive Soc ial Security on retirement because they didn't have to pay into the system. If some of the military people stay in for 20 years and get out as an E-7, they may receive a pension of $1,000 per month, and the very people who placed them in harm's way receives a pension of $15,000 per month.

I would like to see our elected officials pick up a weapon and join ranks before they start cutting out benefits and lowering pay for our sons and daughters who are now fighting.

"When do we finally do something about this?" If this doesn't seem fair to you, it is time to forward this to as many people as you can.
